1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the LearnerGPT website at learnergpt.com and the TeachFlow platform at app.learnergpt.com (collectively, the "Service"), operated by LearnerGPT ("we", "us", "our"), based in Pune, Maharashtra, India.
By accessing the Service, submitting the pilot application form, or using a provisioned account, you agree to these Terms. If you do not agree, do not use the Service.
2. Pilot Programme
The LearnerGPT Pilot Programme provides qualifying educational institutions with free access to TeachFlow Assess for a limited evaluation period.
- Pilot access is granted at our sole discretion after reviewing your application
- The pilot period and scope (number of papers, users, duration) will be confirmed in your onboarding communication
- Pilot access is for evaluation purposes only and does not constitute a commercial agreement
- We reserve the right to modify, suspend, or terminate pilot access at any time with reasonable notice
- No SLA or uptime guarantee applies during the pilot period
3. Permitted Use
The Service is intended exclusively for use by:
- Faculty, professors, and academic staff at accredited educational institutions
- Designated institutional administrators managing faculty accounts
You agree to use the Service only for legitimate academic and institutional purposes. You must not:
- Share your account credentials with any other person
- Use the Service to generate content for institutions other than your own
- Attempt to reverse-engineer, scrape, or copy the platform
- Upload content that infringes third-party intellectual property rights
- Use the Service for any unlawful purpose
4. AI-Generated Content and Faculty Responsibility
TeachFlow Assess uses artificial intelligence to generate exam questions and marking schemes. The following principles apply without exception:
- Faculty approval is mandatory. Every AI-generated paper must be explicitly reviewed and approved by the responsible faculty member before any use. There is no automatic distribution path.
- AI output may contain errors. LearnerGPT does not warrant the factual accuracy, completeness, or suitability of any AI-generated content. Faculty bear full responsibility for the quality and appropriateness of papers used with students.
- Grounding is approximate. Questions are generated from uploaded syllabus content but may occasionally reflect knowledge outside the provided material. Faculty must verify alignment with their curriculum.
5. Intellectual Property
Your content: You retain ownership of all syllabi, course materials, and documents you upload to the platform. You grant us a limited licence to process this content solely for the purpose of generating your exam papers.
Generated output: Exam papers and marking schemes generated using your syllabus content are owned by you and your institution. We claim no intellectual property rights over the generated output.
Platform: All software, design, branding, and technology underlying the LearnerGPT platform is owned by LearnerGPT and protected by applicable intellectual property laws.
6. Data Protection
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service, you also agree to the Privacy Policy.

7. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law:
- We do not warrant that the Service will be error-free, uninterrupted, or secure
- We are not liable for any loss of data, academic outcomes, or indirect damages arising from use of the Service
- Our total liability to you for any claim shall not exceed the amount paid by you for the Service in the 12 months preceding the claim (which, during the pilot, is zero)
8. Termination
Either party may terminate access at any time. We may suspend or terminate your access immediately if you breach these Terms, misuse the platform, or if we discontinue the pilot programme. On termination, your access to the platform will cease and your uploaded data will be handled in accordance with our Privacy Policy.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
10. Changes to These Terms
We may revise these Terms as the platform evolves. The "Last updated" date will reflect changes. Continued use of the Service after changes are posted constitutes acceptance.
